These Terms of Use ("Terms") are an agreement between you, the owner of the Wix site where the app is installed ("you"), and Wix Engine ("we", "us"), the provider of the Shop Concierge app ("the App"). By installing or using the App, you agree to these Terms. If you don't agree, please don't install the App, or uninstall it.

In short

• The App adds an AI shopping assistant to your Wix store. It recommends products from your own catalog and answers questions using the store information you provide.
• Replies are written by AI. They are usually accurate but can sometimes be wrong, so check the information you give the assistant and keep your product details up to date.
• Shopper messages are sent to our AI provider (Google Gemini) to write each reply. We don't sell your data or your shoppers' data.
• You can turn the chat off or uninstall the App at any time.

1. What the App does

The App adds a chat assistant to your Wix site. Your shoppers can describe what they are looking for in their own words, and the assistant recommends matching products from your Wix Stores catalog, shows prices, stock and sale information, lets shoppers choose options and add products to the cart, and answers questions about your store using the information you enter in the App's settings (for example shipping, returns and sizing).

The App also gives you a dashboard to set up the assistant, change its appearance, keep your products in sync, and see Insights about how shoppers use the chat.

2. Eligibility and your Wix account

You must be at least 18 years old and authorised to install apps on the Wix site. The App works only with Wix sites and depends on your Wix account and the Wix platform. Your use of Wix is also governed by Wix's own terms. We are an independent app provider and are not part of Wix.

3. AI-generated replies

The assistant's replies are generated automatically by artificial intelligence. We design the App to recommend only products from your catalog and to use only the store information you provide, but AI can still make mistakes. For example, it may misunderstand a request, recommend a product that is not the best fit, or phrase information inaccurately.

• Replies are for shopping guidance only. They are not professional advice (for example medical, legal or safety advice).
• The product page, cart and checkout always show the actual price, stock and terms. If the chat and your store differ, your store's information applies.
• The App does not create discount codes, accept payments or make promises on your behalf beyond the information you have entered.

4. Your responsibilities

You are responsible for:

• The accuracy of your product information, prices, stock, and the store information and rules you enter in the App.
• Your store's own policies (shipping, returns, privacy) and for following the laws that apply to your business and your shoppers, including consumer protection and privacy laws.
• Telling your shoppers, in your site's privacy policy, that your site uses an AI chat assistant provided by a third party, and how their chat messages are processed.
• Keeping your Wix account secure.

5. Acceptable use

You agree not to:

• Use the App for anything illegal, harmful, misleading or fraudulent, or to sell products that are illegal in your shoppers' locations.
• Try to break, overload, reverse engineer or get around the App's security or usage limits, or use it to send spam.
• Enter content into the App's settings that is unlawful, offensive or infringes others' rights.
• Resell or give access to the App outside your own Wix site, except as Wix allows.

6. Data and privacy

To provide the App, we process the following data on your behalf. Our /apps/shop-concierge/privacy explains this in more detail.

• Your catalog: product names, descriptions, categories, options, prices, stock and images, read from Wix Stores to power product search.
• Your settings: the assistant's name, tone, store information, rules and appearance.
• Chat messages: each shopper message, with the recent conversation and matching products, is sent to our AI provider to write the reply. We don't keep a copy of shopper messages; the conversation is kept in the shopper's own browser.
• Insights: anonymous activity such as the topic of a question, the kind of product requested, the products shown, and clicks and add-to-cart actions on recommended products. This contains no shopper names, email addresses or messages, and is kept for 90 days.

We don't sell your data or your shoppers' data, and we don't use it to advertise to them. Data is stored on Wix's infrastructure. When you uninstall the App, Wix removes the App's access to your site, and the data the App stored for your site is deleted within 30 days.

Where data protection laws apply (such as the GDPR), you are the controller of your shoppers' personal data and we act as your processor, processing it only to provide the App.

7. Third-party services

The App relies on third-party services, including the Wix platform and Google's Gemini API, which generates the assistant's replies and the product search index. We use Google's paid API service, under which Google does not use the content we send to train its models. Third-party services have their own terms, and we are not responsible for their availability or actions.

8. Plans, fees and billing

The App may be offered with a free plan and paid plans. Prices and features for each plan are shown in the Wix App Market and in the App. Paid plans are billed and managed by Wix, and Wix's billing, renewal, cancellation and refund policies apply. We may change prices or plan features with reasonable notice; changes apply from your next billing period.

9. Usage limits

To keep the service fast, fair and affordable, the App applies usage limits. For example, it limits how many messages one shopper or one site can send in a given time. Your plan may also include a monthly number of AI replies. When a limit is reached, the assistant may pause or ask the shopper to try again later.

10. Intellectual property

We own the App, including its software, design and branding. We give you a limited, non-exclusive, non-transferable right to use the App on your Wix site while it is installed and you follow these Terms. You keep all rights to your content, including your products, images and store information, and you give us permission to use it only to provide and improve the App for you. If you send us feedback, we may use it freely without any obligation to you.

11. Availability and changes

We work to keep the App available and reliable, but we can't promise it will be uninterrupted or error-free. It may be unavailable during maintenance, updates or problems with Wix or our AI provider. We may add, change or remove features over time. If we remove a major feature of a paid plan, we will tell you in advance where possible.

12. Suspension and termination

You can stop using the App at any time by turning the chat off in the App's dashboard or uninstalling it from your Wix site. We may suspend or end your access if you break these Terms, if your use puts the service or others at risk, or if we stop offering the App, in which case we will give reasonable notice where possible. Sections that by their nature should continue (such as intellectual property, disclaimers and limitation of liability) remain in effect after termination.

13. Disclaimer of warranties

To the fullest extent permitted by law, the App is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy of AI-generated replies, or that the App will increase your sales.

14. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, or for lost profits, revenue, data or goodwill, arising from your use of the App or from replies generated by it. Our total liability for any claim relating to the App is limited to the amount you paid for the App in the 12 months before the claim, or USD 100 if you used a free plan. Nothing in these Terms limits liability that cannot be limited by law.

15. Indemnity

You agree to defend and compensate us for claims, damages and costs (including reasonable legal fees) arising from your products, your store content, your dealings with your shoppers, or your breach of these Terms or the law.

16. Governing law

These Terms are governed by the laws of the State of Texas, USA. Any dispute will be handled by the courts of Texas, USA, unless the law where you are based gives you the right to bring a claim in your local courts.

17. Changes to these Terms

We may update these Terms from time to time. We will change the "Last updated" date above, and for significant changes we will notify you in the App or by email. If you keep using the App after the changes take effect, you accept the updated Terms.
